How to formalize a valid power of attorney?
If power of attorney is granted in Spain, the granter must appear before a Notary Public.
If power of attorney is granted outside Spain, the granter must appear before a local Notary Public or the Spanish consul, which will act as an Spanish public Notary.
- Step 2a: Notarisation - You must grant the POA and obtain a notarized copy of all the pages of your passport through a local Notary Public or the Spanish consul in your country (recommended).
- Step 2b: Legalisation - Once the documents have been legalized before a your local public notary, they need to be legalized with the Apostille of the Hague convention. Your public notary usually handles this step if requested. This step is not necessary if the POA has been granted before the Spanish consul in your country, since he acts as an Spanish public notary.
-
Step 2c: Submit the documents to our firm by post
The power of attorney must then be legalised via the Hague Apostille of 1961. If it is not granted in Spanish language, then it must be translated by a sworn translator unless it is granted in a Spanish Embassy or Consulate.
To this effect, our firm will submit you a customized POA with columns in both Spanish and English language.
In both cases, the granter should present the public document which testifies to her/his own representative powers or the position that s/he holds within the company.
